Terms and Conditions

When you sign-up for an account with StaminaSys via the “StaminaSys Application” or “the Application”, you are required to check the “I agree to the terms of condition” checkbox before clicking on the “Sign Up” button to signify that you agree to the following Terms and Conditions, you will then become “User” of the StaminaSys Application. If you do not agree to all of these Terms and Conditions, please do not use this Application.

Staminasys may change the content of the Application, including all text, data, information, recordings, graphics, images, icons and any other content (collectively, the Content) at any time without notice. Please review the Terms & Conditions regularly, as your continued use of the Application will constitute your agreement to any changes.

 

N.B: "User(s)": Clinician(s) (eg. osteopaths, massage therapists, naturopaths...), their non-clinical Staff (eg. secretary) and their Client(s).

TERMS OF USE

Users are responsible for maintaining up to date and to ensure the accuracy of the information of their clients posted as Health Record in this Application.

Users are responsible for their log-in credentials and for keeping their information confidential and accurate.

 

Users are responsible for any activity resulting from the use of their log-in credentials on the Application. 

 

NB: Your account is personal to you, and you may not share your log-in information with, or allow access to your account by, any third party. 

 

As you will be responsible for all activities that occur under your access credentials, you agree to prevent unauthorized access to or use of the Application. In the event that you would share your user credentials, StaminaSys will reserve the right to close the account without notice, for security policy.

BE AWARE: StaminaSys Application does not provide any clinical suggestion and does not recommend or endorse any specific tests, Users, products, procedures, opinions, or other information that may be mentioned in the Application. 

This Application should be used ONLY as an Electronic Health Record by Clinicians, their staffs and their Clients ("Users"). Before using StaminaSys Application read carefully StaminaSys User’s Guide 

 

(a) The materials on this Application are provided "AS IS" without warranties of any kind either expressed or implied. StaminaSys shall have no responsibility or liability for any content or materials posted on the Application to the fullest extent possible pursuant to the applicable law, StaminaSys disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or other violation of rights.

(b) Under no circumstances, including, but not limited to, negligence, errors, omissions, shall StaminaSys or its third party licensors be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this app, even if StaminaSys or an StaminaSys authorized representative has been advised of the possibility of such damages. If your use of materials from this Application results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof. Some countries or states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

 

(c) TECHNICAL ERRORS/BUGS. Information on this Application may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. StaminaSys may also make improvements and/or changes in the products and/or services described in this information at any time without notice.

StaminaSys will not be responsible for the consequences of any problems with this Application that may result from bugs, faulty alerts or faulty notifications.

Any piece of software, including this Application, will always be prone to containing “bugs,” meaning areas where the software malfunctions. StaminaSys makes no claim or guarantee that this Application is free of bugs, and users should be aware that bugs could affect any and all parts of this Application. Therefore, StaminaSys will not be responsible for the consequences of a bug that a user may experience.

 

(d) THEFT OR COMPROMISED OF ANY KIND OF INFORMATION. StaminaSys will not be responsible for situations where a user’s personal or not personal information may be stolen or compromised by a breach from the Application. Although this Application adheres to industry standards for maintaining the security and privacy of users information, StaminaSys cannot guarantee that there is no risk of users’ information being stolen or compromised. StaminaSys will not be responsible for stolen or compromised information that results from cyberattacks or users’ negligent behaviour.

 

(e) Suspension or termination. StaminaSys may suspend your connectivity with the Application at any time and on immediate notice if we reasonably believe that such suspension is necessary (i) to prevent imminent threats to the privacy, security and integrity of the Health Record Information or to the performance or availability of StaminaSys Application; or (ii) to comply with any applicable Canadian laws. We will use commercially reasonable efforts to promptly re-instate connectivity upon elimination of threat or potential non-compliance with applicable Canadian laws.

 

StaminaSys can at any time decide to stop offering this Application to users and decide to delete parts or all of the information that is stored in its databases and will not be responsible for any problems or inconveniences that this may cause to users. However, before doing so, StaminaSys will inform you and will give you 30 days notice to save or print your own data. 

 

StaminaSys will not be liable to you or any third party for any modification, discontinuance, or suspension of StaminaSys Application or your Account.

 

(f) Revisions to Terms. We may revise these Terms at any time by posting an updated version, which will be indicated by the date of the most recent change located beside the “Last Modified” date after this section. In this case, you will receive a notification on the Application or an email and may agree to accept this revised user agreement prior to using the Application. If at any time you do not wish to be bound by the terms of use, you must immediately contact us at Support@StaminaSys.com to deactivate your StaminaSys Account in accordance with these terms of use.

StaminaSys Application is operated by Integral Innovation Inc., who owns all copyrights and intellectual property pertaining to this Application.

StamynaSys Application and its contents may only be accessed for personal use. No material from this Application or any applications or web site owned, operated, licensed or controlled by StaminaSys may be used by you for any commercial or resale purposes. Furthermore, no materials may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except to print a copy of a client record for your clinical practice. Modification of the content meaning words , sentences, expressions written by Staminasys, is a violation of StamynaSys’ copyright and other proprietary rights.

 

Eventually, all trademarks, service marks, and trade names (collectively, the “Marks”) are proprietary to StaminaSys or other respective owners. Any use of content or descriptions; any derivative use of this Application or its contents; and any use of data mining, robots, or similar data gathering and extraction tools is strictly prohibited. In no event shall the user frame any portion of the Application or any content contained therein.
